I didn't see SocialTransparency's holiday greetings until now, and had already posted my Happy Holidays in the Across The Backyard fence section but it doesn't show up in recent comments.

And I want to give special thanks to SocialTransparency for all his efforts to hounding DCH to do it's job and do it right. These recent documents show  that progress is being made. Hopefully they will shut Narconon of Georgia down soon.

This should happen very soon or immediately.  There can be no basis whatever for further delay.  The public welfare demands action.

I agree with these sentiments completely, but I'm not going to hold my breath waiting.

If DCH once again lets this go with no action, I believe it will be time for the Feds to start investigating DCH. Because it will mean something seriously wrong is going on with the decision makers there.

The idea that DCH is infiltrated by evil Scientology or otherwise corrupt - as opposed to simply cautious, timid and/or mired in bureaucratic inertia - does not make much sense to me and is almost certainly incorrect in my opinion. 

In fact, I believe all of the elements of a perfect storm are presented for DCH to finally do what has to be done and Narconon of GA is now just barely hanging on by a thin and frayed thread. 

One of the big reasons is the background of Commissioner David A. Cook, who's bio is here: http://dch.georgia.gov/commissioner.  First of all, he is a recent political appointee of Gov. Deal, after working for many years in a lobbyist / public policy position and then as Executive Director for the powerful mainstream medical group known as the Medical Association of GA, and this job is my no means where he wants to see the trajectory of his career crash down.  Secondly, he has a long-standing very close relationship with Gov. Deal and both of these men are smart and savvy enough to not allow themselves to be identified as collaborators with the Scientology criminal enterprise. Finally, he is a well-educated and experienced (although inactive now) attorney who understands and will recognize blatant fraud when smacked in the face by it.

Also, responding to ST's news on the expected additional coverage, this is fantastic and will continue to ramp up the pressure on DCH to take definitive action.

Considering the infiltrations conducted by the Cof$ in the US and Canada during 'Operation Snow White', slipping "ringers" into state level regulatory agencies seems trivial in comparison. It may not be what's going on with DCH, but until it's proved this is all due to bureaucratic inertia/timidity, I'm not going to discount the possibility. Especially if nothing happens after the media expose's on the 26th.

I'm hoping Witnessman is correct. I don't want to believe that corruption is an issue at DCH. I have known them to be very reliable in the past, in my professional life. However, their lack of action in this instance has astounded me. I do realize they have been lied to at every turn by NNGA.

Keeping my fingers crossed and looking forward to the coming media coverage.

It is absolutely true that we shouldn't just assume the regulatory or political systems of the State of GA are being operating in an honest manner.  After all, the entire history of Scientology has for decades demonstrated an almost unlimited capacity to very effectively subvert, bribe, intimidate, lie, cheat and steal and thereby accomplish their nefarious purposes.

In fact, in the strange case of the early 2007 settlement of the administrative appeal of Narconon of GA from DHR's decision to non-renew their license, I strongly believe there was something corrupt - most likely some type of back-channel, fingerprint-free political intervention - that forced the DHR officials to abandon their position, cave in, and allow Narconon of GA to continue to operate.  This situation was discussed, somewhat, in attorney Nina Edidin's deposition, pp 27-28, 32-38, which is linked at comment 222 in the main Desmond case thread.

Note, however, even then, it was the surveyors and decision-makers in the Healthcare Facility Regulation office who had pushed the issue as far as it went, which was 98% of way to Narconon of GA being defunct and shuttered.

And, it is now a very new day with activists and lawyers watching with interest, everything being published almost contemporaneously here on the worldwide web, pending litigation with a mountain of highly relevant evidence, major media coverage, and - last but not least - a different Governor and a different Commissioner.

Man! Clearwater sure is windy at the moment. That and the Brighthouse inter wreck service here is acting kind of odd today. It is a real pain posting on and reading this forum from an iPhone. I hope WSB broadcasts their story. I may need to go to a Starbucks to use my laptop as this viewing via phone is in my opinion cruel to us older folk. That and I may need an intervention after repeated trips to Starbucks as I must confess to a Grande Latte problem I may have. |true|confirmed|

Narconon of Georgia says state intends to revoke its license - AJC

The state Department of Community Health has notified Narconon of Georgia it intends to revoke the clinic’s license for misrepresenting itself as a residential drug treatment facility.

The action came after the department’s latest probe of the Norcross treatment center, the fourth so far this year. In its findings, DCH said that its review of court records from a DeKalb County lawsuit revealed sworn statements from the facility’s executive director confirming that it was knowingly operating as a residential program when licensed only for outpatient services.

An out-of-state drug court manager was also led to believe that the residential services included 24-hour supervision, and the false information harmed the “health and well-being” of the client the court was placing, according to the findings, obtained by The Atlanta Journal-Constitution under an Open Records Request. That client died after a drug overdose.

Barbara Marschalk, attorney for the Norcross treatment center, said Narconon has requested a hearing, as allowed by Georgia law.

“Narconon of Georgia strongly disagrees with the findings mentioned in the Department’s correspondence and corresponding survey report and plans to vigorously oppose any efforts to revoke its license,” Marschalk said Wednesday in a statement. “Narconon of Georgia plans to take all steps allowed under Georgia law to respond to and oppose any sanctions against it as they are unfounded and unwarranted and appear to be based solely on disputed documents produced in connection with an ongoing and very contentious civil lawsuit against it related to events that occurred more than four years ago.”

State looks into Narconon of Georgia -WSB radio

Narconon of Georgia, already embroiled in a lawsuit over the death of a patient who was court ordered into a residential drug treatment program that in fact never existed, now faces revocation of its license by Georgia health regulators.

 Documents obtained from the State Department of Community Health by WSB Radio News under an Open Records Request show Narconon of Georgia has been found to be violating its license by running a residential drug rehab program while only permitted to operate as an outpatient facility.

 The allegations have plagued Narconon of Georgia since it was founded in 2002. But unable to subpoena witnesses and documents, the Department of Community Health (formerly the Department of Human Services) has been unable to prove in court that Narconon has run a residential program while claiming to be operating an outpatient facility.

 Why would someone do that?

 “By claiming to be a residential program, they can obviously charge a lot more,” said Attorney Jeff Harris. He is suing Narconon on behalf of Patrick Desmond’s family after Desmond died in 2008. (Read more here) Narconon’s executive director is accused in that lawsuit of telling both Desmond’s family and the drug court administrator in Brevard County, Florida, that hers was a 24-hour residential treatment facility when it is not. Desmond, 28, drank throughout his stay at Narconon, according to his family. He then returned home to Florida, relapsed, and was sentenced to return to Narconon. There, according to the lawsuit, while drinking with staff members, he decided to try heroin. He died from a combined overdose of alcohol and heroin.

 While profit is one motive for Narconon to claim it is a residential program even though it is not licensed as such, Harris said an outpatient facility is not under as much scrutiny by regulators as is a residential program. In his suit, which is set for trial in Dekalb County State Court on February 11, Harris contends Narconon has tried to conceal its residential operations by claiming they are separately owned and operated. Harris said testimony and a raft of documents proves that the separate company, Discovery Course, is actually a mere shell company operated by Narconon Executive Director Mary Reiser.....

.....For the first time, inspectors cited violations, which fall into the state's most serious tier, meaning they "caused death or serious physical or emotional harm" or"pose an imminent and serious threat."

Investigators also reviewed evidence "confirming that Narconon of Georgia was knowingly operating as a residential program ... that the facility failed to update its license ... and provided misleading information to the public which negatively affected the health and safety of [Patrick Desmond]."

Desmond died in 2008 while enrolled at Narconon of Georgia. A Florida drug court ordered him into inpatient treatment for alcohol addiction. But he got drunk with his housing monitor, left with two program flunkies, and tried heroin for the first time....
