In reading the depositions I have 2 general comments:
1. The plaintiff attorneys showed extreme patience, persistence and professionalism in the NN and NN int employee depositions. Asking the questions over and over and pursuing the answer while getting non-answers had to have been the most frustrating thing to endure. I broke up when Claudia Arcabascio (director of legal affairs, NN int) started going on about a misundersood word she wanted to look up; then later when she did not understand the word "blow" and the attorney asked if she had heard of the book "Blown for Good".
2. Even Jamie Thompson who had little memory (due to heroine) of the night Patrick died had more comprehensible answers then the NN and NN int employees.

Haven't read them all yet, but Jeff Harris is very persistent and methodical.  He was absolutely prepared and appeared to be focused on the direction and disproving the false statements based on the documentation provided.  I've met a few of the people he had to depose and could actually hear their voices and see their mannerisms while reading some of this, making it all the more real and commending him in my mind for having to dig through the intended deception he has been dealt thus far.

Jamie Thompson was with Patrick W Desmond the night he passed away. Here is the 911 call made from the side of interstate 285 on that tragic night. The women heard in the background is Jamie Thompson.

 http://www.hark.com/clips/fzyrglkmwq-911-call-to-save-patrick-w-desmond-narconon-client

Having read her deposition it just tears me up inside to see a young women fighting an addiction while under the care of Narconon of Georgia. Then to hear of the ease in which drugs are/were available while @ Narconon of Georgia.

Yes, me too.  After having heard the 911 call and read the witness statement to the police from that night, I had developed an attitude about Jamie and Bradley, one that resulted in quite some adjustment after reading their depositions, where they were revealed to be victims themselves.  With the chaos at the housing as described by multiple people, it is hard to understand how anyone could come out of there without developing a worse substance abuse problem than when they went in.  They are both haunted by what took place that night, and probably will be, for the rest of their lives.

And reading the heart wrenching Deposition of Mary C. Desmond, Patrick's mother, was almost too much, and it brought me to tears when I read:
Quote
Q. Had Patrick passed by the time you got there?
A. Not legally.
Q. So tell me what happened.
A. I went into the room and Patrick was there with all the tubes and things that kept pumping him.  The doctor came in and spoke to me telling me what was going on and the fact that, you know, he was legally brain dead and his body was functioning from machines.  I laid with Patrick in the bed and I held him....

and then she described how she made the decision to take him off of life support.   :.{....

These ought to keep you happy occupied for a while!   ;)

After the "Plaintiffs' Motion to Unseal Documents", and the non-party "Petition by Ann Lowe and Matthew Hurley To Unseal Documents Of Record And Open Depositions", Narconon of Georgia filed a "Motion To Keep Certain Documents Filed With The Court Under Seal".  This is the Plaintiffs response to Narconon of Georgia's Motion.  I can say for an absolute fact that the petitioners are two happy people now, but are awaiting the unsealing of the documents that remain "Under Seal".   ;)

I am not in the least bit surprised by anything within the above documents. A decade long culture has been in place that gave rise to this whole sordid affair. This acceptable managorial/culture has co-existed within the operational procedures of Narconon of Georgia,Narconon International, its branch operations within the state of Georgia AND as an acceptable managorial/culture/ structure within the State of Georgia,s Department of Community Health.

As I type this, many of the same issues revealed within the above documents are in fact apparently still acceptable to the state of Georgia and the Department of Community Health. Nothing has changed! Narconon of Georgia is in operation.  Discovery Course is in operation.  Pur-o-cleanse is in operation.

All the above entities are in fact operational per Georgia Department of Community Health license and or other state license.

One may ask, Why is this occurring? Why when the Georgia Department of Community Health is fully aware of the operational procedures executed by Narconon of Georgia and its branches? Why when the Georgia Department of Community Health is FULLY aware of not only this lawsuit, but also ongoing Narconon of Georgia and its branches continued operations outside the scope of state issued licenses?

Those questions have in fact been repeatedly asked of the Georgia Department of Community Health.

Brian Looby, Division chief Healthcare Regulations has been written to directly, yet does not appear to have the professional courtesy in replying to or communicating with a state of Georgia tax payer as to concerns over Narconon of Georgia!

Richard C Green General Counsel has been written to directly,Yet does not appear to have the professional courtesy in replying to or communicating with a state of Georgia tax payer as to concerns over Narconon of Georgia!

Inspector General Toni Prine is fully aware of this situation, yet also appears unable to address a state of Georgia tax payers concerns over this whole matter.

This posters ongoing personal experience with the above mentioned state agency points towards an agency currently unable to meet the needs of we the citizens of Georgia and those out of state individuals whom may use the services of DCH licensed facilities. There is plenty of culpability to go around here within this wrongful death lawsuit.

Some of that culpability does in fact lay at the doorsteps of the Georgia Department of Community Health and its Healthcare Facilities regulations department!

I got a bug to search for NN inpatient to see how well they have scrubbed the net. I ignored the previous dual diagnosis and inpatient adds discussed previously.

Freedom Magazine lists NN Georgia as in-patient (2003 from the contents).
http://www.freedommag.org/english/cw/iss16/page12.htm

The header of this page is NN Int and it describes NN Georgia as inpatient.
http://www.narconon.org/drug-rehab/georgia/macon.html
"The last phase of Narconon inpatient services is important when someone is striving toward sobriety. The recovering addict must learn life skills that enable him or her to make the right decisions in a new drug-free life. When he returns home after rehab, he will face similar stresses and challenges to those he faced before entering the treatment program. He needs knowledge and tools to be able to cope with these stresses."
THere is also a statement that suboxone, etc do not work so they are never used at NN. Yeah, right.

At the StopAddiction site: http://stopaddiction.com/index.php/Metro/Atlanta-Drug-Rehab/Inpatient-Rehab-Atlanta.html
"If you or someone you love is struggling with substance abuse and are searching for inpatient drug rehab in Atlanta Georgia, call Narconon Arrowhead today. Narconon Arrowhead is one of the world's largest and most effective inpatient drug rehabilitation and education programs with a success rate of over 70% of those who graduate. Narconon Arrowhead offers free addiction counseling, free assessments, and referrals to the residents in Atlanta Georgia. To locate an Atlanta inpatient drug rehab or find out information about drug abuse contact Narconon Arrowhead by calling 1-800-468-6933 or via email at info@stopaddiction.com."
I think there is lots of stuff connecting this site to NN. Also on the blog page with the big NN logo, http://www.stopaddiction.com/blog/ it is filed under "NN blog" further down after several entries.

Very nice, who me?.  Let's hope the Plaintiffs' attorneys are watching this thread as closely as the Defendents' attorneys are.   L-O-:

Bringing over another nice comment from WWP by anonysamvines (I wish the comments were being made here, so the attorneys might see them if they're watching - hint, hint, anonysamvines):

Quote
So Maria and Mary both said Don at times did not work for Narconon yet Don says he worked continuously for Narc hmm. Discovery Path wasn't narc but Mary didn't like the guy running Discovery Path and just asked Don if he wanted to hmmm. Ooh Don is the only one i have seen, so far, to claim that there was another company (formed by Johnno an ex "student") who got sent any students let alone about half Oops Oh and nawty Don - you are supposed to list all assets in bankruptcy aren't you? wonder if you would get in trouble for that, especially when sworn under oath.
Wouldn't you expect Don and Maria to know who is paying for their attorney? other than not me but not sure. Especially since Maria thought maybe Don or?. Wouldn't their attorneys want to know who to bill before working the case? oops
First one to claim they had a Dr. come in monthly to train them, that they had regular visitors from narconon int. He keeps trying to say they do what should be good standard business practise (contradicting other depo) - then goes oh no never had any convos with anyone about doing an investigation into circumstances around P's death, nothing to do with me i only worked narc that was housing.

and to cap it all when it appears his deposition is done he tells them they can ask any more questions they like as he is paid by the hour. Darling Jeff picks him up on it " you said you were paid by the hour so you'd sit here awhile, it seems to me you'd be losing money sitting here" (ie your current employer Terminix isn't going to pay). oh was a joke i am losing money. Sure Don sure..Hope ya getting the same rate as the wog psychiatrist - i like Co$ to pay lots of money for crap.

Jeff Harris you make me very wet watching you work!

be very interesting to know who initially instructed Don and Maria's attorney, who paid for them and who provided the $ to settle their case.

If Tony Ortega at the Village Voice wants to know about Narconon of Georgia's licensing, perhaps he should first ask why did the State settle the administrative appeal in January 2007.  The Georgia DHR, Office of Regulatory Services, Health Care Section, had denied their renewal application, which effectively put them out of business.  There was no reason to settle and the ORS people didn't just suddenly have a change of heart.  But something happened.  In her deposition, Nina Edidin wasn't asked what it was.  Perhaps if some bold journalist were to look into that strange matter a bit further, it might shed some light on why they are still operating today.

Just saying.

Welcome to the Tipping Point, Witnessman.  Some of us have been very curious about that also.  Have you seen the thread about DCH (the new version of DHR) and records requests, here: http://forum.reachingforthetippingpoint.net/index.php/topic,10057.0.html

This post from that thread shows something similar may have happened in early June, this year:

"Karin Pouw, a spokeswoman for the Church of Scientology, did not specifically address the use of Mr. Hubbard’s program for dioxin, but said it “has had many applications” and had been used “for more than three decades to handle environmental toxins, exposure to pesticides and drug rehabilitation.”"

Good tip.

Dr. An would do well to listen to the experts quoted in the article.

Quote
“I would not expect that it would lower the body burden of dioxin in a given person,” said Dr. Marcella L. Warner, a research epidemiologist at the University of California, Berkeley, who studies the long-term health effects of dioxin exposure. While unfamiliar with the specifics of the detoxification program in Vietnam, she said that a treatment focused on exercise and sweating would not be an effective way to rid the body of the toxin.

Christopher Hodges, a spokesman for the American Embassy in Hanoi, said the United States government was also skeptical of the detoxification program. “We are not aware of any safe, effective detoxification treatment for people with dioxin in body tissues,” he said. “The best way to reduce health risks associated with dioxin is to prevent human exposure to dioxin.”

From the article:

The United States government has not provided any financing for the program in Vietnam, he said.

Thank God for small favors!

Quote
The Vietnamese government has cooperated with the Association for Better Living and Education since 2005, when the association provided financial help “to build steam baths and buy the vitamins and minerals,” according to the Vietnamese state news media.

Dr. Vuong said Tuesday that the association had helped “transfer technology on detox and purification.”

“They are not preaching religion,” he said.

At least not religion as you know it, Dr. Vuong.   |>-)>

Quote
By using the Hubbard method, the victims will be detoxified through the physical process of perspiration, digestion and urinary excretion, An said.

According to the treatment plan, victims will be prescribed high content vitamins in the early morning and told to exercise strenuously for half an hour to excrete sweat; the more sweat the better.

Later, they will be taken to a sauna to perspire profusely, and the toxic chemicals will leave the body.

The 24 people selected to try this method first are those who have the highest dioxin content in their blood.

Results from this first set will be recorded so that lessons can be learned and applied later to mass treatment.

“This Hubbard method has been applied in many countries for detoxication and treatment of several diseases. But Vietnam is the first nation in the world to apply it to dioxin,” An confirmed.

I wonder how long before we have to start a Dioxin Detox Deaths list?   :(

Their scope of practice is for rehab and emergency services. WTF? ???  The license in this section is their Georgia license 050724.

Just for reference, the codes are at: http://www.wpc-edi.com/reference/
