Suing Narconon

Does anyone have any advice or suggestions on how to get my money back from NN? I was at the South Texas facility and sexual harassed by a staff member and treated extremely bad by all staff and interns there. The program did nothing to help me and they violated my HIPPA rights and lied to my family. Has anyone successfully gotten their money back? Please help!

I'm sorry to hear about your experiences with Narconon in South Texas. Sadly, sexual harassment is not an uncommon complaint at many of the Narconon facilities.

From what I understand, getting your money back from Narconon is not an easy business. Some of the other members on our forum can probably provide more information on that topic.

Client Bill of Rights

The following text is from the Texas Administrative Code Title 25, Part 1, Chapter 448, Subsection G, Rule §448.701, “Client Rights”.  Please note that the language below refers to legacy agency Texas Commission on Alcohol and Drug Abuse (TCADA) as the rule was written prior to the consolidation of TCADA with other agencies to become the Department of State Health Services (DSHS).  Where TCADA is mentioned by name in the rule, the same applies to DSHS.

            The facility shall respect, protect, implement and enforce each client right required to be contained in the facility's Client Bill of Rights. The Client Bill of Rights for all facilities shall include:
                You have the right to accept or refuse treatment after receiving this explanation.
                If you agree to treatment or medication, you have the right to change your mind at any time (unless specifically restricted by law).
                You have the right to a humane environment that provides reasonable protection from harm and appropriate privacy for your personal needs.
                You have the right to be free from abuse, neglect, and exploitation.
                You have the right to be treated with dignity and respect.
                You have the right to appropriate treatment in the least restrictive setting available that meets your needs.
                You have the right to be told about the program's rules and regulations before you are admitted, including, without limitation, the rules and policies related to restraints and seclusion. Your legally authorized representative, if any, also has the right to be and shall be notified of the rules and policies related to restraints and seclusion.
                You have the right to be told before admission:
                    the condition to be treated;
                    the proposed treatment;
                    the risks, benefits, and side effects of all proposed treatment and medication;
                    the probable health and mental health consequences of refusing treatment;
                    other treatments that are available and which ones, if any, might be appropriate for you; and
                    the expected length of stay.
                You have the right to a treatment plan designed to meet your needs, and you have the right to take part in developing that plan.
                You have the right to meet with staff to review and update the plan on a regular basis.
                You have the right to refuse to take part in research without affecting your regular care.
                You have the right not to receive unnecessary or excessive medication.
                You have the right to have information about you kept private and to be told about the times when the information can be released without your permission.
                You have the right to be told in advance of all estimated charges and any limitations on the length of services of which the facility is aware.
                You have the right to receive an explanation of your treatment or your rights if you have questions while you are in treatment.
                You have the right to make a complaint and receive a fair response from the facility within a reasonable amount of time.
                You have the right to complain directly to the Texas Commission on Alcohol and Drug Abuse at any reasonable time.
                You have the right to get a copy of these rights before you are admitted, including the address and phone number of the Texas Commission on Alcohol and Drug Abuse.
                You have the right to have your rights explained to you in simple terms, in a way you can understand, within 24 hours of being admitted.
            For residential sites, the Client Bill of Rights shall also include:
                You have the right not to be restrained or placed in a locked room by yourself unless you are a danger to yourself or others.
                You have the right to communicate with people outside the facility. This includes the right to have visitors, to make telephone calls, and to send and receive sealed mail. This right may be restricted on an individual basis by your physician or the person in charge of the program if it is necessary for your treatment or for security, but even then you may contact an attorney or the Texas Commission on Alcohol and Drug Abuse at any reasonable time.
                If you consented to treatment, you have the right to leave the facility within four hours of requesting release unless a physician determines that you pose a threat of harm to yourself and others.
            If a client's right to free communication is restricted under the provisions of subsection (b)(2) of this section, the physician or program director shall document the clinical reasons for the restriction and the duration of the restriction in the client record. The physician or program director shall also inform the client, and, if appropriate, the client's consenter of the clinical reasons for the restriction and the duration of the restriction.

Hi gohogs518, and welcome.  I deleted your duplicate post; I hope you don't mind.  I'm also going to move this one to the Narconon section where it will get more exposure.  The "Forum News, How-to's, Suggestions, and Requests" section is kind of like a ghost town most of the time.   :)

Mary McConnell will probably have some suggestions when she sees your post.  In the meantime, I think the best way to start is by sending them a letter telling them that you want a refund, and outlining why.  Here is a list of Texas consumer agencies you can choose the best one from, and cc: them on your letter.  Actually add "cc: Agency Name" to the bottom of your letter to let Narconon know that you're serious (but of course, fill in the name of the one you think is best instead of "Agency Name").   ;)

Right after your letter is sent (or before), you can start making complaints - to the licensing agency that mefree posted, here (where your experience can be seen by others), and also on http://ripoffreport.com.

Narconon seems to take refund requests more seriously when the person is causing them public relations problems by making complaints left and right and posting about it - small wonder, huh?  If and when they agree to give you a refund, they will probably ask you to sign an agreement not to talk about your experience there, so it's important to say anything you want to say that will warn others before you sign the agreement.

What is the best thing to do about signing their gag document, especially if the person wants to leave open the option to sue? It does not seem that if you are entitled to a refund that they could demand that you sign anything other than acknowledgment that they returned your money and the check cleared.

I'm really sorry you went through all that.

Getting a refund is not an easy task. There are many variables. It depends upon whether a contract was signed, how long the person stayed in the program, how far one got in the program and who paid for the program.

At WWP, you stated that your mother paid for the program using your trust funds. If she is the manager of the trust, she would have to obtain the refund or sue to get it - not you. I'm sorry you and your mother are not seeing eye to eye on the program. There are many Moms who have been lied to and if you need another mother to talk with her and explain her experiences, let me know and I will get someone for you.

There is nothing against you filing a lawsuit or police complaint against the facility and staff member for sexual harassment. Most attorneys will want a fee upfront to take the case. Usually $5,000 down payment to start but you should check with the bar association or see if  attorney Ray Jeffrey would be willing to take your case or know of someone who would. He has represented people in cases against the Church of Scientology in his state. You would have to inform him that Narconon is a Scientology front group, as I don't know whether he knows this or not.

It's important that you file complaints to the state licensing agency and the state consumer affairs against the facility. Narconon in TX is NOT licensed. It is owned by Narconon Fresh Start , which is a California corporation doing business in TX. 

I don't know why they are allowed to operate without a license but they do. They 'retired' their license years ago.

[..]Fortunately, there is now help for Texas. Six years ago, a new Narconon drug and alcohol rehabilitation center was opened in Harlingen, Texas. Harlingen is located just a stone's throw from two of the heaviest drug trafficking corridors in the country: Brownsville and McAllen.

This Narconon is the only residential facility in the area for those who are determined to kick their addictions and live clean and sober lives. Most of those choosing this Narconon for their recovery from substance abuse come from Texas, Florida, New Mexico and New York. Many Texans who have encountered legal problems necessitating residence in the state solve the dilemma by selecting this Narconon drug and alcohol rehabilitation facility.

Harlingen is served by its own international airport, making transportation to the rehabilitation facility simple. As many as 22 individuals can seek a drug-free life at any one time, and they are serviced by 12 staff. Four staff are Certified Chemical Dependency Counselors. In the last six years, nearly 50 people have graduated to their new drug-free lives.

The facility maintains a home-like atmosphere, with one portion of the house being allocated for women who are overcoming addiction, and one wing being devoted to male residents. The grounds include a gym, volleyball court, swimming pool and laundry. Seventeen acres of Old West terrain surround the drug rehabilitation facility, providing privacy and space to walk and relax.

The Public Information Act
Texas Government Code, Chapter 552 , Public Information, gives you the right to access government records, and an officer for public information and officer's agent may not ask why you want them.   §448.406. Inactive Status and Closure.
(a) Inactive Status. The Commission will automatically retire the license of a facility site in which services are suspended or not provided for more than 60 days, unless the facility sends a writtenrequest to place the license on inactive status. To be eligible for inactive status, the facility must bein good standing with no pending legal actions or investigations.
(1) If granted, inactive status is limited to 60 days. The licensee is responsible for alllicensure fees and for proper maintenance of client records while on inactive status.
(2) To reactivate the license, the facility shall submit a written request to reactivate the license no later than the date the inactivation period expires.
(3) If the license is not reactivated, it will be automatically retired at the end of the 60 day deactivation period.

Does anyone have any advice or suggestions on how to get my money back from NN? I was at the South Texas facility and sexual harassed by a staff member and treated extremely bad by all staff and interns there. The program did nothing to help me and they violated my HIPPA rights and lied to my family. Has anyone successfully gotten their money back? Please help!

Well, the best way to start the process is a  typed up strongly worded letter sent certified mail, return receipt requested.  Be sure to use the words false, fraud, fraudulent, abuse, abused, and abusive as liberally as possible; and tell them you intend to hire an aggressive trial lawyer and to file a major lawsuit, unless they send a full refund - state the specific dollar amount - in 20 days.  Keep a copy and the return receipt green card when it comes back to you.

If they contact you, do not talk to them except to repeat what you said in the letter and tell them they best send the check or you will file a lawsuit. Be sure to get the person's name and write it down. And tell them to never call you again.  Anything they have to say, put it in writing.

If they show up or you are further harassed at all, call the police, file a complaint, get a copy of the police report.

If the letter doesn't do the trick, call one time within the first 3 or 4 days after the deadline and demand to speak with somebody with some real authority.  Again, repeat what you said in the letter and tell them they best send the check or you will file a lawsuit.  Again, be sure to get the person's name and write it down. Tell them you are not talking to them after this call and to instead put it in writing.

If all else fails, find a local trial lawyer who is willing to do some research and learn what he is going to be dealing with, and who actually takes cases to trial ... you know, a real lawyer with guts who will kick ass and take no crap from fraudsters.  There are definitely a bunch of that type in Texas.  Find one.

The point is they might or probably will pay, but only if they realistically think the situation will become a bigger problem than the usual "I want my money back" request.

Good points.  Having been on the receiving end of those letters I can tell you they work.  I wouldnt do 20 days though, more like 7.  They didnt give you 20 days to cough up the money for entry into the program i would imagine.

Also, any attorney you hire, have them come to this website and others to get informed.  They may not know the breadth of the problem.

Ensure you get copies of anything you signed and WHEN you signed them.  NN's try to get ironclad legal agreements.  If you signed them while in withdrawal or before I believe they are inadmissable or if the person who paid didnt sign then its also may be inadmissable.  They try to use those as leverage but typically will still settle if you bring a suit against them.
