New Business:
Special Use Permit for 300 Care Center Drive, Manistee, Michigan.

A letter has been received from Kreis, Enderle, Udgins (sic) & Borsos, PC Attorneys for Per Wickstrom and TIA Corporation, Inc. asking the Planning Commission for a six month extension for the Special Use Permit (SUP) for 300 Care Center Drive.  The Special Use Permit is currently held by Bellasam Inc.  Due to financial difficulties the facility was closed in September 2010.  The six month extension (March 15, 2012) is to allow Mr. Per Wickstrom and TIA Corporation, Inc. the opportunity to acquire the property and resume operations of the facility.

At this time, the Planning Commission can approve/deny the request for a six month extension of the Special Use Permit for 300 Care Center Drive, Manistee, Michigan (March 15, 2012).



At the end of the packet is a letter from Per's lawyer, to support his request for the extension of the Special Use Permit, and a copy of the Special Use Permit originally granted to Bellasam (Kate Wickstrom), in 2006. 

Summarized, the letter states:

January 19, 2007: A land contract was executed between Manistee Heights Care Center, Inc. and Tendercare Inc. (as vendors) and TIA Corporation (as vendee). 

October 31, 2007: Sellers  assigned their interest in 300 Care Center Drive to Michigan Living Centers Limited Partnership.

~2008: Per and Kate divorce.  Per became the sole owner of TIA, and Kate became the sole shareholder of Bellasam, Inc.  TIA assigned its interest under the land contract to Bellasam.

Per says that Bellasam lost the property by failing to make payments to Michigan Living Centers, failing to pay state and federal income taxes and withholding taxes, and failing to pay property taxes.  "Various governmental agencies imposed tax liens on the property in the amount of $60,000."  Bellasam went insolvent, and Michigan Living Centers initiated an action against Bellasam to reclaim the property.

The letter also says: "TIA wants to operate a drug and alcohol rehabilitation facility on the Property, and the validity of the SUP is a prerequisite for TIA to pursue acquisition of the property.  If the SUP expires, TIA is investigating the acquisition other sites (sic) outside of the City and outside Manistee County."

NEW BUSINESS:

Commissioner Gustad declared a conflict of interest under Section 3.12.1.f of the By-Laws.

MOTION by Maureen Barry, seconded by Marlene McBride that the Planning Commission postpones deliberation on the request until the September 1, 2011 Meeting so that a representative could be present to discuss the request.

Jon Rose spoke to the Commission about the request. The applicant was not told they needed to attend the meeting. Mr. Rose also noted that by postponing the request the permit may expire since we are unsure of the date the facility closed.

With a Roll Call vote this motion failed 2 to 6 with Commissioner Gustad Abstaining.
   Yes: Barry, Mc Bride,
   No: Dean, Fortier, Albee, Crockett, Neider, Yoder

MOTION by Dave Crockett, seconded by Linda Able to approve the request for a six month extension of the Special Use Permit for 300 Care Center Drive, Manistee, Michigan (March 15, 2012).

With a Roll Call vote this motion passed 6 to 2 with Commissioner Gustad Abstaining.
   Yes: Albee, Crockett, Dean, Fortier, Neider, Yoder
   No: Barry, McBride

Would be good to contact the current council member and let them know they let the church of scamontology in their back.  Im sure they would be happy to know about the fraud and abuse occurring.

If they're like some of the Sandy Springs Council members we saw during the Atlanta Ideal Org zoning meetings, that would make them quake in their boots.

Knd of funny that a City of only 4.47 square miles, with such a small population would have 7 districts, each with a representative

I just threw up in my mouth reading this shit.  I'll search around a bit more on this site to see what's been posted, but this guy and his operations should suffer the same fate as GA before someone gets killed there too.
